What is a "defective" vehicle?

 

A: A "defective" vehicle is one that, due to a flaw or deficiency in the design, manufacture or marketing of the vehicle, renders it unreasonably dangerous. The "defect" can cause the accident, such as a defective tire, or a sudden acceleration, or it can cause injuries that otherwise would not have occurred in a particular crash. An example of this second type of defect would be an exploding fuel tank. An occupant would not have suffered fatal or serious injuries in a minor rear end collision but for the fire that ensued. If the accident or injury could have been avoided by reasonable design changes, or by proper manufacturing or by better warnings and/or instructions, then the product may be unreasonably dangerous.
