I am an experienced Dallas personal injury lawyer handling injury and wrongful death cases throughout Texas
Police in Texas have long been concerned about the apparent disregard of safety regulations among construction trucks. For example, an officer with the Euless Police Department pulled over the driver of a dump truck on Airport Freeway when he noticed that its brake lights were not working.
Upon further inspection, it was found that the dump truck not only had missing and broken brake lights, but the brakes on the trailer were on the brink of total failure. In addition, a single chain was holding a front loader to the trailer, and several other large items sat on it unsecured. Like too many drivers of construction vehicles, the driver had no commercial license.
Safety Violations, Lack of License not Isolated Incidents
In response to incidents such as this one, police across Texas have taken matters into their own hands. While the Texas Department of Public Safety is charged with enforcing construction truck safety violations, local police forces, tired of the accidents dangerous Texas construction trucks are causing, have begun certifying their officers in commercial vehicle inspection. The following cities currently have officers who carry the certification:
Arlington
Burleson
Dallas
Denton
Euless
Flower Mound
Fort Worth
Frisco
Garland
Grand Prairie
Grapevine
Hurst
Irving
Lewisville
Mansfield
North Richland Hills
Plano
Richardson
Inspections Begin, Too Many Trucks Fail
Lewisville is just one example of a city that has seen the impact of unsafe construction trucks. Police Chief Russ Kerbow recently spoke to the seriousness of the safety issue in this city.
“Since this January we’ve inspected 213 trucks, resulting in 248 citations,” he said. “We put 133 of those trucks out of service and wrote more than 1,300 warnings for minor violations.”
Too many times, drivers know they are operating an unsafe vehicle but don’t feel they can speak up and ask that the truck or trailer be repaired. In fear of losing their jobs, they often leave the site and find a police officer, whom they beg to put them out of service.
